NI Connect Terms and Conditions

The terms and conditions detailed herein (the “Agreement”) govern your registration and attendance at the NI Connect virtual event of July 27th – 28th, 2021 (the “Event”). Registering to attend the Event constitutes your acceptance of this Agreement.

 

1. THESE TERMS

NI reserves the right to update this Agreement at any time without notifying you first. If NI updates or otherwise changes this Agreement, the updated Agreement will be posted on the Event website. The updated terms will become effective and binding on the next business day after they are posted. If the Agreement is changed, the "Last Modified" date above will be updated to reflect the date of the most recent version. We encourage you to review these terms periodically. Registering to attend the Event constitutes your acceptance of this Agreement.

 

2. AGE LIMITATION

Unless otherwise indicated, you must be 18 years of age to attend this Event and all related events.

 

3. AUDIO AND VIDEO RECORDING

You grant NI, its affiliates, employees, agents, and independent contractors the right to record, film, and capture your voice and image at the Event. We do not prohibit participants, exhibitors, sponsors, news organizations or other companies from video- or audio- taping activities during sessions. By attending this Event, you grant to NI and its affiliates the right to use, modify, reproduce, broadcast, distribute, display, or incorporate in any manner whatsoever, all or any portion of any recordings of you for use in marketing materials and/or training materials and for internal use. NI’s foregoing rights shall be perpetual, worldwide, and free of royalties or any other compensation.

 

4. YOUR INFORMATION

a. Generally. We may collect, manage and share your information in accordance with NI’s Privacy Statement and all applicable data privacy laws and regulations.

 

Based on the topics of interest you select during the registration process, we may make recommendations on sessions that may be of interest and you may refine the scheduling tool by providing feedback. In addition to information requested at the time of registration, we may collect information relating to your session attendance, participation (for example through Q&A instances or requests to interact with experts), and preferences to make recommendations or improve the Event or other future events.

 

b. Data Sharing with Third Parties. We may provide your contact information to a sponsor if (a) you elect to attend any activities at the Event involving the sponsor, or interact on the sponsor’s landing page such as by attending sessions, demos, and one-on-one sessions, (in which case we would provide your contact information only to the sponsor involved in such session or other activity), or (b) you opt in during registration or otherwise to receive communications from the sponsor.

 

Your data may be shared with NI and its affiliates if you were invited to the Event by a sponsor or if you registered through a sponsor.

 

5. CODE OF CONDUCT

NI Connect organizers are committed to creating a safe experience and will not tolerate harassment or discrimination of event participants in any form. Every Event attendee is responsible for promoting and creating a safe experience for all participants. Please review our NI Connect Event Code of Conduct, which details these expectations and provides contact information for filing a complaint.

 

6. ADMITTANCE

NI, at its sole discretion, reserves the right to refuse admittance to or expel from the Event anyone for any lawful reason, including but not limited to anyone that is behaving in a manner that could be disruptive to the Event or any other attendee.

 

7. VIEWS

The views or opinions expressed by any Event attendee, speaker, exhibitor or sponsor are not necessarily those of NI. All Event attendees, speakers, exhibitors, and sponsors are solely responsible for the content of any and all individual or corporation presentations, marketing collateral, advertising and online web content.

 

8. STATEMENT OF LIABILITY

Except where prohibited by applicable law, NI does not bear any legal liability or responsibility for any device or connection failure or data loss or theft from such device or connection failure relating to your attendance of this Event. NI disclaims any liability for the acts of any outside entities related to this Event and NI reserves the right to cancel the Event without liability.

 

Each attendee shall be personally responsible for his/her behavior. NI does not accept responsibility for the behavior of any attendee or outside entity during the Event. NI shall not be liable for any delays or failure in performance or interruption of services resulting directly or indirectly from any cause or circumstance beyond the reasonable control of NI including but not limited to, acts of nature, pandemic, war, terrorism, failure of transportation, weather, accidents, fires, electrical failures, strikes, labor disputes, postal delays, explosions, government orders or regulations. You agree to indemnify, defend, and hold harmless NI, its officers, directors and agents, against all claims arising out of your actions or omissions at or in connection with this Event.

 

EXCEPT WHERE PROHIBITED BY APPLICABLE LAW, NI AND ITS AFFILIATES DISCLAIM ANY AND ALL DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, PUNITIVE OR OTHER DAMAGES OF ANY KIND WHETHER ALLEGED AS A BREACH OF CONTRACT OR TORTIOUS CONDUCT, INCLUDING NEGLIGENCE, OR BASED ON ANY OTHER CAUSE OF ACTION. If applicable, NI reserves the right to substitute an equally qualified speaker in case of an emergency or cancellation. NI has no duty with respect to presenters, sponsors, and makes no endorsements of any presentation or product.

 

9. CHOICE OF LAW

This Agreement shall be governed by the laws of the State of Texas, U.S.A., without regard to principles of conflicts of laws. The parties attending this Event submit to the personal jurisdiction of the state and federal courts in Travis County, Texas.
